What is a Notary Public?

A Notary Public is a state-appointed official authorized to witness the signing of important documents, administer oaths, and deter fraud by verifying the identity of the signer.

What does notarization mean?

Notarization is the official process of verifying a signature on a document by a Notary Public. It confirms the signer’s identity and willingness to sign the document without duress or intimidation.

Why do documents need to be notarized?

Notarization helps deter fraud and ensures the document is legally valid and enforceable. It is often required for legal, financial, and real estate documents.

Can a Notary give legal advice or draft documents?

No. Notaries are not attorneys (unless they are separately licensed). They cannot offer legal advice or draft legal documents unless authorized to do so by law.

Can a Notary refuse to notarize a document?

Yes. A notary can refuse if:

  • The signer cannot provide valid ID

  • The document is incomplete

  • The signer is not willing or aware of what they are signing

  • The notary suspects fraud

Can a document be notarized without the signer present?

No. The signer must appear in person before the notary at the time of notarization. Even in the case of a remote online notarization, the signer must still be present via audio & video at the time of notarization.

What is the difference between an acknowledgment and a jurat?

Acknowledgment:

  • Signer confirms they signed the document voluntarily.

Jurat:

  • Signer swears or affirms (under oath) the contents of the document are true.

  • The signature must be observed as well.

What is a mobile notary?

A mobile notary travels to your location—home, office, hospital, etc.—to perform notarizations. It's convenient for clients who cannot travel.

In accordance with CRS 24-21-529 (1) and 24-21-529 (2), the maximum fee allowed for a notarization is $15 per document/signature* that includes receiving evidence of signer’s identity; Administering an oath or affirmation (if applicable); And applying the signature, notarial certificate, and stamp of the notary.

Additional fees apply for document review and preparation, printing and handling, loan signing presentation, witnesses (that we source), administration, travel, and convenience.
